The New Jersey Supreme Court has adopted amendments to Rules of Evidence 803 (c) (25) and 804 (b) (3)

The amendments to the hearsay rules were announced in a Notice to the Bar issued on September 15, 2023. The new hearsay evidence rules go into effect on July 1, 2024.

The adoption of the new rules followed a Judicial Conference Judicial Conference on the Proposal to Amend Rules of Evidence 803 (c) (25) and 804 (b) (3) that took place on September 7, 2023.

NJAJ President Patricia M. Giordano, Esq. And Christina Vassiliou Harvey, Esq, a co-chair of the NJAJ Civil Practice Committee, appeared at the Judicial Conference and spoke against the rule change.

NJAJ also submitted written comments opposing the rule change.
