The Live Trial of a Premises Liability Case: Overcoming Pareja program at the Meadowlands Seminar 2023 is designed to show lawyers that the “Ongoing Storm Doctrine” created by the New Jersey Supreme Court in Pareja v. Princeton International Properties does not automatically prevent a successful claim.
“Many lawyers think that the decision in Pareja means that if it was raining or snowing when your client got hurt, the property owner is protected from a lawsuit,” said Adam B. Lederman, Esq., who is co-chairing the program on Thursday, November 16 with Deborah S. Dunn, Esq. and Lauren D. Fraser, Esq.
“What this mock trial will show lawyers is that there can be another reason for your client to have fallen and become injured that is unrelated to any storm that might be taking place at the time of the incident,” Lederman said.
The program will allow lawyers to watch top trial attorneys actually try a real case. They will learn tips and tools to use at their next trial, he said.
“Lawyers need to recognize that they have to look for other reasons for a slip and fall than a storm,” Lederman said. “That does not mean that the defense counsel might not try to raise a storm as a defense, but this program will show how to raise arguments and evidence to counteract that.”
